CIVIL PRACTICE AND PERSONAL INJURY CASES
We practice in all Maine courts as well as the federal system, including appellate practice. The field of civil litigation includes a wide variety of cases, such as personal injury (accident), employment disputes (both employee and employer), construction contract disputes (both homeowners and builders), and all other private disputes that require judicial resolution.
Current state court procedure calls for mandatory alternative dispute resolution (ADR) either before or after a formal court complaint is filed. In many cases, the ADR leads to a prompt and less expensive resolution than proceeding to a court trial. We are experienced in ADR as well as jury and non-jury civil trials.
If you have been injured in an accident or incident caused by another person’s fault (negligence), you are legally entitled to be compensated by that person (or, more frequently, by that person’s insurance company) for your financial losses (such as lost income and medical bills) and also for your discomfort, “pain and suffering,” among other categories of legal damages.
There are two general legal issues in such a case: “liability” and “damages.” Liability means establishing that another person was at fault, and damages means establishing the monetary amount to which the injured is entitled.
